These Terms of Use (“Terms”) govern your use of the Volume Booster mobile application (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1 Acceptance of these Terms
By accessing or using the App you confirm that you can form a binding contract, that you will comply with these Terms and all applicable laws, and that you accept our Privacy Policy, which is incorporated into these Terms by reference. If you are using the App on behalf of someone else, you represent that you are authorized to accept these Terms for them.
2 Licence to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on a device you own or control, for your own personal, non-commercial use. Your use of the App is also subject to the Google Play Terms of Service and the terms of your device and app store.
3 Acceptable use
You agree not to:
- copy, modify, translate, reverse-engineer, decompile, or disassemble the App, or attempt to derive its source code, except to the extent this restriction is prohibited by law;
- rent, lease, sell, sublicense, or otherwise distribute the App;
- use the App for any unlawful purpose, or in a way that infringes the rights of others;
- interfere with or disrupt the App, its security, its advertising, or the servers and networks it relies on;
- remove or obscure any notices, or attempt to bypass, disable, or defraud the advertising that supports the App.
4 Volume, hearing & device safety
The App is a tool that amplifies and adjusts your device’s audio. You are solely responsible for the volume levels you choose. Prolonged listening at high volume can cause temporary or permanent hearing loss, and boosting beyond your device’s designed output may distort or damage speakers and headphones. Start low, raise the level gradually, and stop if you experience any discomfort. Do not use the App at unsafe volumes while driving, cycling, or in any situation where you need to hear your surroundings. To the fullest extent permitted by law, we are not liable for any hearing damage, device or equipment damage, or other harm resulting from the volume levels or effects you apply.
5 Advertising
The App is provided free of charge and is supported by advertising served through Google AdMob. Ads are provided by third parties, and we are not responsible for the content of ads or for any third-party websites or offers they link to. Your interactions with advertisers are solely between you and the advertiser.
6 Third-party services
The App uses services provided by Google (including AdMob and Firebase) and depends on your device’s operating system and audio effects, which may vary by manufacturer and Android version. Some effects (such as bass boost or the 3D virtualizer) may not be available or may behave differently on certain devices. Your use of third-party services is subject to their own terms and policies, and we are not responsible for those services.
7 Intellectual property
The App, including its software, design, text, graphics, logos, and other content (excluding third-party ad content and your own audio), is owned by us or our licensors and is protected by intellectual-property laws. Except for the licence granted above, these Terms do not give you any rights in the App or our trademarks.
8 Updates and availability
We may update, change, suspend, or discontinue the App or any of its features at any time, with or without notice. Updates may be required for the App to keep working. We do not guarantee that the App will always be available, uninterrupted, or error-free.
9 Disclaimer of warranties
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your requirements, achieve any particular loudness or sound quality, or operate without interruption or error. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
10 Limitation of liability
To the fullest extent permitted by law, we and our suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, hearing damage, or damage to devices or equipment, arising out of or relating to your use of (or inability to use) the App. To the extent liability cannot be excluded, our total liability to you for all claims relating to the App is limited to the amount you paid for the App, which for a free app is zero. Nothing in these Terms limits liability that cannot be limited under applicable law.
11 Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the App or your violation of these Terms or applicable law.
12 Termination
These Terms remain in effect while you use the App. You may end them at any time by uninstalling the App. We may suspend or terminate your licence if you breach these Terms. Provisions that by their nature should survive termination (including sections 4, 7, 9, 10, and 11) will continue to apply.
13 Children
The App is not directed to children under 13, and because it shows ads and uses analytics, you should not use it unless you meet the minimum age required by law in your country to consent to such data processing.
14 Governing law
These Terms are governed by the laws applicable in the jurisdiction where the developer is established, without regard to conflict-of-law rules. Depending on where you live, the mandatory consumer-protection laws of your country of residence may also apply and are not affected by this section.
15 Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Your continued use of the App after an update means you accept the revised Terms.
